Consensual sex between same sex couples at age sixteen (16) is lawful.


Criminal Code of Azerbaijan (Unofficial translation)

Article 152. Sexual relations and other actions of sexual nature with the person who has not reached of age 16

The Sexual relations or other actions of sexual nature, committed by a person who has reached 18, with the person who is wittingly known as person who has not reached 16 - is punished by restriction of freedom for the term of up to three years or imprisonment on the same term [L1.1].

In May 2000, a new statute was passed legalising gay male sex. It came into effect in September. The new statute bans only forced sex [R1.2].

Lesbian sex was never banned.

Previously:

Male anal sex was prohibited by Criminal Code Article 113 [R1.2].

Developments

On 22 September 2017, it was reported that over the last several days, police in Baku, Azerbaijan carried out mass arrests of at least 100 members of the LGBT community. In official statements, local authorities and government-friendly NGOs described the arrests as a crackdown on prostitution, but lawyers and local activists describe indiscriminate arrests of gay men and transgender women in organised raids on apartments and bars, as well as seemingly random arrests on the street [R1.1].
